The FSBO Checklist: how to sell your home by owner in Florida

Selling your house by owner in Florida is legal, and this checklist walks you through every step: pricing with market research, pre-listing prep and disclosures, marketing, showings, offers and negotiation, and closing. You handle the process directly and keep the listing commission for yourself, and in exchange you take on the pricing, exposure, and paperwork work that a listing agent would normally do. Work through the steps in order, and when a step gets heavy, there are FSBO help options below, including Kelly's FSBO Backup Option.

A single-story Florida home with a for sale sign at the curb in golden-hour light
Quick Answer

Can you sell a house by owner in Florida?

Yes. Florida does not require a seller to hire a Realtor. You can sell your own home, but the work does not disappear, it moves to you: you price it with real market research, complete Florida's property disclosures, get the home in front of buyers through the MLS and other marketing, negotiate a contract with the buyer's agent, and close through a title company or closing agent. Many FSBO sellers handle the middle of that process fine, then hit a wall at one step, usually pricing, showings, or the offer paperwork. That is where the FSBO Backup Option below comes in. You keep the sign and the savings, and Kelly picks up the step that is stalling.

One more quick one

Can I list my FSBO in the MLS?

Not by yourself. Only a licensed brokerage can place a listing in the MLS, so sellers use either a flat-fee MLS service or an agent. The MLS matters because most buyers shop through their agent and the buyer portals that pull from it. A home that is not in the MLS is invisible to the largest share of buyers.

The Checklist

Six steps from sign to closing, in order

This is the full by-owner sequence, from setting the price to handing over the keys. Tick off every item before you move to the next step, and the process stays under control instead of running you.

01

Price it with market research

Price is the biggest lever in an FSBO sale. Pick your number with evidence, not hope, or the home sits while the market moves on.

Checklist

  • Pull the most recent sold homes in your neighborhood: sale price, size, condition, and roughly how long each one took to sell.
  • Compare the active listings you are competing against, and note the similar homes that expired without selling.
  • Adjust for your home's condition, upgrades, lot, and traffic exposure, honestly.
  • Run your own numbers: what you owe, what you need to net, and what that implies for the price you list.
  • Get a second read on the price from a local Realtor who knows the area before you commit to a number.

02

Pre-listing prep and disclosures

Buyers judge in the first minutes. Fix what scares them, clean everything, and get the paperwork ready before the sign goes in the ground.

Checklist

  • Finish the small repairs that show up in photos: touch-up paint, dripping faucets, torn screens, worn hardware.
  • Deep clean and declutter room by room, and stage the rooms that photograph first.
  • Gather your paperwork: deed, survey, tax records, HOA or CDD documents, permits, and any warranties.
  • Complete Florida's seller disclosures about the home's condition and any known defects, and answer buyer questions honestly.
  • Decide whether you are selling as-is or handling repairs, and price accordingly.

03

Marketing

Most buyers find their home through their agent and the MLS. FSBO marketing has to reach both, or the sign only works on your street.

Checklist

  • Get the home into the MLS. Sellers cannot place their own listing, so use a flat-fee MLS service or an agent.
  • Take professional photos: good light, straight angles, every room, and the outside after the lawn is cut.
  • Write an honest, complete description with the features and upgrades buyers actually ask about.
  • Add a video walkthrough or virtual tour, and share it on every channel you have.
  • Put up the sign, run open houses, and tell your neighbors, but expect most buyer traffic to arrive through agents.
  • Reach out to buyer agents directly, since many will only show homes they know exist.

04

Showings

A showing is a first impression with a deadline. Make the home ready, make access easy, and make it safe.

Checklist

  • Set showing hours or use a lockbox so agents can show the home without a round of phone tag.
  • Never show a home alone at night. Have someone with you and keep your showing schedule public.
  • Prep before every visit: lights on, blinds up, clutter cleared, and fans or AC set so it feels comfortable.
  • Have a one-page info sheet and the disclosure documents ready to hand to every visitor.
  • Collect feedback after each showing so you learn whether price, condition, or marketing is the problem.

05

Offers and negotiation

The offer is where FSBO sellers can give back the money they saved. Read every line, and get everything in writing.

Checklist

  • Review the buyer's financing, pre-approval, earnest money, and contingencies before you react to the price.
  • Compare each offer against your net proceeds, after your mortgage, fees, and any concessions.
  • Negotiate like a transaction, not a friendship, and respond to every offer or counter in writing with clear deadlines.
  • Take inspection results seriously and negotiate repairs or credits deliberately instead of caving or refusing.
  • Buyers will usually bring their own agent. Their contract protects them, so make sure your side is protected too.

06

Closing

Closing is where the details get expensive. Confirm the process with a title company or closing agent, and walk in with a checklist of your own.

Checklist

  • Confirm the title company, closing agent, or attorney who handles the title search, settlement statement, and transfer.
  • Expect the buyer's inspection and appraisal to be scheduled before closing, and stay available for both.
  • Review the settlement statement line by line: mortgage payoff, prorated taxes, fees, and the final net to you.
  • Complete the agreed repairs and the final walkthrough terms before signing day.
  • Sign with photo ID, hand over keys and garage openers, transfer utilities out of your name, and keep copies of everything.

FSBO FAQ

Straight answers

Can you sell a house by owner in Florida without a Realtor?

Yes. Florida does not require a seller to hire a Realtor. You can sell your own home, but you still have to price it with market research, complete Florida's property disclosures, market the home so buyers find it, negotiate the contract, and close through a title company or closing agent.

Do FSBO sellers in Florida have to fill out a disclosure form?

Florida sellers must disclose what they know about the property's condition. The standard way to do that is the Florida seller's property disclosure form, completed honestly before you market the home. Disclosing known defects up front is how sellers protect themselves from disputes after closing.

Can an FSBO home get into the MLS?

Only through a licensed brokerage. Sellers cannot place their own listing in the MLS. You can pay a flat-fee MLS service to place it, or list with a Realtor. Most buyers shop through their agent and the buyer portals that pull from the MLS, so that placement is where buyer traffic actually comes from.

What should I fix before selling my house by owner?

Fix what photographs badly and what buyers flag in inspections: touch-up paint, dripping faucets, torn screens, worn hardware, and anything that suggests neglect. Deep clean and declutter every room. Skip major renovations unless a repair is actually failing, since buyers rarely pay dollar for dollar for upgrades.
